1. Acceptance of Terms

By accessing or using the INFOLUX website (infolux.com) and/or engaging our consulting services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our website or services. These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and INFOLUX ("Company," "we," "us," or "our"), a consulting firm headquartered in Kyrenia, Northern Cyprus (TRNC).

2. Our Services

INFOLUX provides premium consulting services across four verticals:

  • Real Estate: property search, market analysis, purchase and rental support, legal due diligence, property management, and resale services in Northern Cyprus.
  • Education: university selection, application support, student visa processing, scholarship advisory, accommodation arrangements, and ongoing student support.
  • Investment: investment opportunity identification, portfolio advisory, citizenship-by-investment pathways, land banking, and tourism investment consulting.
  • Legalization: residency permits, citizenship applications, company registration, power of attorney, title deed transfers, and regulatory compliance.

The specific scope, deliverables, timelines, and fees for each engagement are defined in the individual Service Agreement signed between the Client and INFOLUX prior to commencement of work.

3. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding agreements in your jurisdiction to use our services. By engaging our services, you represent and warrant that you meet these eligibility requirements. For education services involving minors, the parent or legal guardian must be the contracting party.

4. Client Obligations

When using our services, you agree to:

  • Provide accurate, complete, and current information as required for service delivery.
  • Respond to our communications and requests for documentation in a timely manner.
  • Comply with all applicable laws and regulations in your home country and in Northern Cyprus.
  • Not use our services for any illegal purpose, including but not limited to money laundering, tax evasion, fraud, or any activity that violates TRNC or international law.
  • Not provide falsified documents or misrepresent your identity, financial status, or intentions.
  • Pay all agreed fees in accordance with the terms of your Service Agreement.

5. Service Agreements and Fees

All consulting engagements are governed by a separate written Service Agreement that specifies the scope of work, timeline, fee structure, and payment terms. Key provisions include:

  • Fees are quoted in the currency specified in your Service Agreement (typically EUR, GBP, USD, or TRY).
  • A deposit may be required before work commences, as outlined in the Service Agreement.
  • Fees for third-party services (government filing fees, notary fees, university application fees, property registration fees, etc.) are the Client's responsibility and are separate from INFOLUX consulting fees.
  • Payment terms, including due dates and accepted methods, are detailed in the Service Agreement.
  • Late payments may incur interest at the rate specified in the Service Agreement.

6. Cancellation and Refunds

Cancellation and refund terms are governed by your individual Service Agreement. General principles include:

  • You may cancel a service engagement by providing written notice to INFOLUX.
  • If cancellation occurs before any work has commenced, you are entitled to a full refund of any advance payments, minus a reasonable administrative fee.
  • If cancellation occurs after work has commenced, fees for work already completed are non-refundable. Any unused portion of prepaid fees may be refunded at INFOLUX's discretion, based on the stage of completion.
  • Third-party fees that have already been paid on your behalf (government fees, application fees, etc.) are non-refundable.
  • INFOLUX reserves the right to terminate a service engagement if the Client breaches these Terms, the Service Agreement, or applicable law.

7. Intellectual Property

All content on the INFOLUX website — including text, graphics, logos, images, videos, the INFOLUX brand identity, and the underlying software — is the intellectual property of INFOLUX or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our website without our prior written consent. The INFOLUX name, logo, and all related marks are trademarks of INFOLUX. Unauthorized use is strictly prohibited.

8. Website Use

When using our website, you agree not to:

  • Use the website for any unlawful, fraudulent, or malicious purpose.
  • Attempt to gain unauthorized access to our systems, servers, or data.
  • Introduce viruses, malware, or other harmful code.
  • Scrape, crawl, or extract data from our website using automated tools without our written permission.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the operation of the website or the experience of other users.

9. Disclaimer of Warranties

Our website and its content are provided on an "as is" and "as available" basis. While we strive to ensure that information on our website is accurate and up to date, we make no warranties or representations, express or implied, regarding the completeness, accuracy, reliability, or availability of the website or the information, services, or related content. To the fullest extent permitted by law, INFOLUX disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Information on our website does not constitute legal, financial, investment, or tax advice. Always consult qualified professionals before making decisions based on information obtained from our website.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • INFOLUX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.
  • Our total liability for any claim arising under or in connection with these Terms or any Service Agreement shall not exceed the total fees actually paid by you to INFOLUX for the specific service giving rise to the claim.
  • INFOLUX is not liable for delays, failures, or outcomes caused by factors beyond our reasonable control, including but not limited to government decisions, regulatory changes, third-party actions, natural disasters, pandemics, or force majeure events.
  • INFOLUX does not guarantee the outcome of any application, transaction, or process, including but not limited to residency permits, citizenship applications, university admissions, or property purchases, as these are ultimately subject to the decisions of the relevant authorities.

11. Indemnification

You agree to indemnify, defend, and hold harmless INFOLUX, its directors, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your breach of these Terms, your misuse of our services, your violation of any law or regulation, or your infringement of any third-party rights.

12. Confidentiality

Both parties agree to maintain the confidentiality of all non-public information exchanged during the course of the consulting engagement. INFOLUX will not disclose your personal or financial information to unauthorized third parties, except as required by law or as necessary to provide the agreed services (see our Privacy Policy for details). You agree not to disclose INFOLUX's proprietary methods, internal analyses, pricing structures, or confidential business information.

13. Force Majeure

INFOLUX shall not be held liable for any failure or delay in performing our obligations under these Terms or any Service Agreement if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, epidemics or pandemics, government actions or sanctions, strikes or labor disputes, internet or telecommunications failures, or power outages. In the event of a force majeure, affected obligations will be suspended for the duration of the event, and INFOLUX will make reasonable efforts to resume performance as soon as practicable.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Turkish Republic of Northern Cyprus (TRNC). Any disputes arising out of or in connection with these Terms or our services shall be resolved as follows:

  • Negotiation: the parties shall first attempt to resolve any dispute through good-faith negotiation within 30 days of written notice.
  • Mediation: if negotiation fails, the parties agree to attempt mediation before a mutually agreed mediator in Kyrenia, TRNC.
  • Litigation: if mediation is unsuccessful, the dispute shall be submitted to the competent courts of the TRNC, which shall have exclusive jurisdiction.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, it shall be deemed severed from these Terms.

16. Entire Agreement

These Terms, together with our Privacy Policy and any applicable Service Agreement, constitute the entire agreement between you and INFOLUX regarding the subject matter herein. These Terms supersede all prior or contemporaneous oral or written communications, proposals, and representations with respect to the website and general service terms. In the event of a conflict between these Terms and a Service Agreement, the provisions of the Service Agreement shall prevail.

17. Changes to These Terms

INFOLUX reserves the right to modify or update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
